Terms of Service

Last updated: October 8, 2026 · Cold-Store Benchmark

The agreement between you and Cold-Store Benchmark.

1. These Terms

These Terms of Service ("Terms") govern your access to and use of Cold-Store Benchmark (the "Service"), provided by ThermoNeural (Cold-Store Benchmark), a sole proprietorship trading as R7AD, operating from 570 Hood Road, Unit 14 #1596, Markham, ON L3R 4G7, Canada ("we", "us", "our"). By creating an account, subscribing, purchasing a report, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Cold-Store Benchmark publishes an engineering model of refrigeration running cost per pallet position, by market, built from public data (published electricity tariffs, climate normals and refrigerated-warehouse capacity statistics). You can buy a one-off Metro Report for a single market, or subscribe to the market index and re-runnable model.

We may add, change or remove features, and we may suspend or discontinue the Service or any part of it, at any time. Where a paid feature is discontinued, we will not bill you for it after the date it stops being available.

3. Plans, prices and billing

The plans and prices advertised on this site are the current prices. As displayed on our pricing section at the time of writing:

Purchases are completed through Stripe payment links on this site; the charge appears as COLDSTORE on your statement. The currency and tax shown at checkout is the currency and tax you pay. There is no free trial and no setup fee.

Amounts are stated in the currency shown at checkout and exclude applicable taxes, which are added where required. By starting a paid plan or purchase you authorise us and our payment processor to charge the stated amount to your payment method. You are responsible for keeping your payment details current; if a charge fails we may suspend the paid features until it succeeds.

The Metro Report is a single, one-off digital deliverable. The Index subscription is a recurring monthly charge — see section 4.

4. Automatic renewal (recurring charges)

Each subscription tier is a recurring charge. When you subscribe, you authorise Stripe to charge the amount displayed at checkout for your tier (for example $490, $1,250, $3,500, $599 or $1,499 per month) each month to your payment method on the same day of each month, starting on the date of purchase, and to keep doing so until you cancel. Subscriptions renew automatically every month. The Portfolio (Enterprise) tier may instead be paid annually in advance ($35,000 per year), in which case it renews annually until cancelled.

We will send a receipt by email each time you are charged. Because the term is monthly and short, we do not send a separate advance renewal reminder before each monthly charge; the automatic renewal is disclosed here, on the subscription button, and at Stripe checkout before you pay. You can cancel at any time as described in section 5. The one-off Metro Report is not a recurring charge and does not renew.

5. Cancellation and refunds

Cancel the Index subscription at any time — email us hello@thermoneural.com or use the Stripe customer portal link in your receipt. Cancellation stops future renewals; it does not automatically refund the current month, and access continues to the end of the period you have already paid for (the rest of the month you are in). We do not pro-rate partial months.

If you are charged in error, or a renewal is taken after we confirm your cancellation, contact us and we will refund it. If the Service does not work as described, tell us within 30 days of the charge and we will investigate and, where the fault is ours, refund the affected period. Nothing here removes any refund right you have under applicable consumer protection law.

Metro Reports are made to order and delivered digitally. Because the report is prepared for you, the default position is that a purchase is final once delivery has started. That said, if you have not received it, or it does not match what this site described, we will put it right or refund it. Ask before ordering if you need a change-of-mind window and we will confirm in writing.

6. Your account and acceptable use

You are responsible for the accuracy of the information you give us, for keeping your login credentials confidential, and for activity under your account. You agree not to: use the Service unlawfully or to infringe anyone's rights; attempt to access accounts, data or systems you are not authorised to access; scrape, resell or redistribute the Service or its output except as expressly permitted; reverse engineer or circumvent usage limits, quotas or technical protections; upload malicious code; or use automated means to place an unreasonable load on the Service.

We may suspend or terminate access, with notice where practicable, if these Terms are breached or if we are required to do so by law or by a third-party provider.

7. Your content and our data

You keep ownership of the content and materials you submit. You grant us a limited licence to store, process and transmit that content only to operate and support the Service and as described in our Privacy Policy. The model's assumptions, constants and source-data provenance are published with the report and on this site so you can check them.

The Service's own content, design, code, model and compiled data are and remain our property or that of our licensors, protected by copyright and other laws.

8. No professional advice — you must verify output

Cold-Store Benchmark is an engineering model built on public data, not a utility bill. It estimates what a facility of a given profile should cost to run in a given market; it does not report what a specific facility actually paid. It is a screening and comparison tool for professionals.

Output from the Service is informational only. It is not professional advice of any kind — not engineering, architectural, refrigeration, HVAC, electrical, legal, accounting, financial, tax or medical advice — and it is not a substitute for a qualified professional engaged for your situation. You are solely responsible for independently verifying any output (including figures, assumptions, methods and source data) before relying on it or acting on it, and for complying with all laws, codes, safety requirements and standards that apply to you.

9. Disclaimer of warranties

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING ANY WARRANTY OR CONDITION OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, secure, timely or error-free, that defects will be corrected, or that any output, figure, model or data set will be accurate, complete, current or reliable. Third-party source data (such as published tariff, weather, capacity and inventory data) is used as published and may contain errors or be revised. You use the Service and its output at your own risk.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, SAVINGS, GOODWILL, DATA OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE WERE ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) CAD $100. These limits apply singly and cumulatively, and they survive termination.

11. Indemnity

You agree to indemnify and hold us harmless from claims, losses and reasonable costs arising from your use of the Service, your content, or your breach of these Terms — except to the extent caused by our own negligence or wilful misconduct.

12. Changes, suspension and termination

We may update these Terms. If we make a material change we will post the updated Terms on this page with a new revision date, and where the change affects a paid plan we will give reasonable advance notice (for example by email or in-product notice). Continued use after the effective date means you accept the updated Terms. You may stop using the Service at any time; if you do not agree to a material change to a recurring plan, contact us before the change takes effect and we will cancel that plan.

13. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules. You and we attorn to the exclusive jurisdiction of the courts located in Ontario, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidentiality.

14. Consumer protection and severability

Nothing in these Terms excludes, restricts or modifies any right, remedy, warranty or condition you have under applicable consumer protection law — including the Ontario Consumer Protection Act, 2002 and any equivalent legislation of your province or territory — that cannot lawfully be excluded, restricted, waived or modified. Where any part of these Terms conflicts with such a right, that right prevails to the extent of the conflict, and the rest of these Terms continues to apply.

If any provision is found to be invalid, illegal or unenforceable, it will be severed or modified to the minimum extent necessary and the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
